1. Privacy Policy

We care deeply about your privacy and data security.
Ob Cruz Photography does not sell, share, or store personal information beyond what is needed to communicate with clients, process payments, and deliver photography services.
All details collected through this website, booking forms, or email are used solely for your photography experience and are never shared with third parties.

2. Digital Negatives & Copyright

All photographs, videos, and digital negatives are protected by U.S. Federal Copyright Law (All Rights Reserved).
Ob Cruz Photography retains full ownership of all images.

Clients receive personal-use rights only—you may print, share, and display your images for personal enjoyment.
Commercial or promotional use, resale, or publication requires written permission.
Altering, filtering, or editing images in any way that changes their artistic integrity is not permitted.

3. Reservation & Payment Terms

A 30% non-refundable retainer secures your date and time.
This payment is applied toward your total balance.
Remaining balances must be paid by the due date on your invoice.
No photography will take place until payment is complete.

If you cancel or reschedule, the retainer will not be refunded.
If a new date is available, your retainer may be transferred at the photographer’s discretion.

4. Rescheduling, Weather & Cancellations

Outdoor sessions are weather-dependent.
If conditions (rain, wind, smoke, etc.) would harm quality or safety, Ob Cruz Photography may reschedule without penalty.
If you cancel instead of rescheduling, the retainer is forfeited.

Clients arriving 20 minutes or more late will lose that time from the session, with no extension or refund.

5. Client Conduct & House Rules

Sessions may take place at a client-selected or recommended location.
Some venues have rules, fees, or restrictions that may affect the shoot; by booking, you accept those limitations.

Ob Cruz Photography complies with all site regulations and assumes no liability for restrictions imposed by property management.
Clients are responsible for cooperation of all participants.
No third-party photographers or videographers are allowed during the session unless pre-approved.

6. Model Release

By booking, you grant permission for Ob Cruz Photography to use selected images for marketing, portfolio, website, and social media purposes.
If you prefer privacy, please submit a written request before your session to opt out of promotional use.

7. Image Delivery & Digital Galleries

Edited images are delivered via a secure online gallery within 2–4 weeks.
Galleries remain active for 90 days from delivery.
Clients must download and back up files within that time frame.
Gallery reactivation or file retrieval after expiration may incur an additional fee.

Re-edit Window:
Minor re-edit or revision requests (color balance, cropping, exposure adjustments) are accepted within 5 days of gallery delivery.
After 5 days, all images are considered approved and final.
Any later editing or re-touching requests will be billed at the current hourly post-production rate. Raw Files are deleted after the 5 window closes.


RAW (unedited) files are not released.

8. Return & Refund Policy

All sales are final.
Prints and wall art are fulfilled through WHCC or equivalent professional labs to ensure premium quality.
Due to the custom nature of photography, no refunds, exchanges, or returns are accepted once a session is completed or a product order is placed.

9. Limit of Liability

In the event of illness, injury, or emergency beyond the photographer’s control, Ob Cruz Photography will attempt to secure a qualified replacement photographer.
If none is found, liability is limited to a refund of all payments received.

While professional-grade equipment and backups are used, in rare cases of file loss, theft, or corruption, liability is also limited to the return of all payments received.

10. Intellectual Property (Website & Content)

All images, text, and designs on the Ob Cruz Photography website and social media are intellectual property of Ob Cruz Photography.
No content may be copied, downloaded, or reproduced without written consent.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington.
Any disputes will first be handled through mediation or small-claims proceedings in Benton County, WA, before further legal action.

12. Updates to These Terms

Ob Cruz Photography may update these Terms at any time.
The current version will always be available on this website, and continued use of services indicates acceptance of the most recent Terms.
